Rome I: where is a service supplied at a distance, for Article 6(4)(a)?
Article 6(4)(a) takes out of the consumer rules services to be supplied to the consumer exclusively in a country other than that of his habitual residence. For a service supplied at a distance, for example online advice used by the consumer at home, the text does not say where the service is supplied.
Consequence
The same online service can fall inside or outside the consumer protection of Article 6.
Proposed correction
The Commission's work on the application of the Regulation could say where such a service is supplied.
