ARXO-2026-0444 · Reported
Rome II, Croatian version: does Article 4(2) apply to the person claimed to be liable or only to a person whose liability is established?
The other versions apply the common habitual residence rule to the person claimed to be liable. The Croatian text speaks of the person whose liability has been established.
Consequence
Read alone, the Croatian rule assumes liability before the applicable law that decides it has been found.
Proposed correction
The lawyer-linguists could say whether the wording should be aligned with the other versions: align Croatian Article 4(2) with the person claimed to be liable.
