Rome I, Maltese version: Article 8(4) refers to paragraph 2 or 2a, and there is no paragraph 2a

The other versions of the escape clause for employment contracts refer to paragraphs 2 or 3. Article 8 has no paragraph 2a.

Consequence

In the Maltese text the comparison with a more closely connected country leaves out the country of paragraph 3 (the place of business that engaged the employee) and names a paragraph that does not exist.

Proposed correction

Replace 2a with 3 in Maltese Article 8(4).
