Rome II, Greek version: should Article 11(1) on negotiorum gestio refer to unjust enrichment, as the 2014 corrigendum made it?
The Greek corrigendum of 31 December 2014 replaced, in Article 11(1), the words with this non-contractual obligation by with that unjust enrichment. Article 11 is about negotiorum gestio, and the original Greek wording, like the other versions, tied the connection to that obligation. The same corrigendum also corrected Article 10(1), on unjust enrichment.
Consequence
A court that reads the Greek text looks for the country most closely connected with an unjust enrichment that may not exist in a case of negotiorum gestio.
Proposed correction
The lawyer-linguists could say whether the wording should be aligned with the other versions: restore the original Greek wording of Article 11(1).

Ρώμη ΙΙ, ελληνική απόδοση: πρέπει το άρθρο 11 παράγραφος 1 για τη διοίκηση αλλοτρίων να παραπέμπει στον αδικαιολόγητο πλουτισμό, όπως προβλέπει το διορθωτικό του 2014;
Το ελληνικό διορθωτικό της 31ης Δεκεμβρίου 2014 αντικατέστησε στο άρθρο 11 παράγραφος 1 τις λέξεις «με την εξωσυμβατική αυτή ενοχή» με τις λέξεις «με αυτό τον αδικαιολόγητο πλουτισμό». Το άρθρο 11 αφορά τη διοίκηση αλλοτρίων, και η αρχική ελληνική διατύπωση, όπως και οι άλλες γλωσσικές αποδόσεις, συνέδεε την υφιστάμενη σχέση με την ενοχή αυτή. Το ίδιο διορθωτικό διόρθωσε επίσης το άρθρο 10 παράγραφος 1, για τον αδικαιολόγητο πλουτισμό.
Consequence
Δικαστήριο που διαβάζει το ελληνικό κείμενο αναζητά τη χώρα με την οποία συνδέεται στενότερα ένας αδικαιολόγητος πλουτισμός που ενδέχεται να μην υπάρχει σε περίπτωση διοίκησης αλλοτρίων.
Proposed correction
Οι γλωσσομαθείς νομικοί θα μπορούσαν να διευκρινίσουν αν η διατύπωση πρέπει να ευθυγραμμιστεί με τις άλλες γλωσσικές αποδόσεις: αποκατάσταση της αρχικής ελληνικής διατύπωσης του άρθρου 11 παράγραφος 1.
