AI Act: which evaluation satisfies Article 82(1) when a compliant system presents only a risk to another public interest?
Article 82(1) applies, having performed an evaluation under Article 79, to a compliant high-risk AI system that presents a risk, including a risk to other aspects of public interest protection. Article 79(2) requires an evaluation for risks to health, safety or fundamental rights, and Article 74(1) applies the general market surveillance framework of Regulation (EU) 2019/1020. The text does not say which evaluation satisfies Article 82(1) where the only risk is to another public interest.
Consequence
For an authority that finds only a risk to another public interest, the text does not say which evaluation lets it act under Article 82.
Proposed correction
The guidelines could say which evaluation applies.
