FAR 25.205(c): should the minimum consideration for a postaward exception cite 25.204 directly?
FAR 25.205(c) sets the minimum consideration for a postaward exception based on unreasonable price by reference to the amount “established in 25.202(a) or in accordance with agency procedures”. Paragraph 25.202(a)(3) sets no amount; it points onward to 25.204, which adds 20 percent of the cost of the foreign construction material. Clauses 52.225-9(c)(2) and 52.225-11(c)(2) state their own minimum by reference to the evaluation factor in each clause. One reading takes the reference to 25.202(a) to reach the 25.204 factor through (a)(3). The other reads 25.202(a) as naming no amount, so that the minimum comes from agency procedures or the clause.
Consequence
No contract with a different consideration amount under either reading has been established.
