Recognition of arbitral awards: Article 14(4) of the Constitutional Statute and Article 45(1) of the Arbitration Regulations; the English translation of Article 14(4) is narrower than the Russian and Kazakh texts

Article 14(4) of the Constitutional Statute (Russian and Kazakh texts) provides that recognition and enforcement of arbitral awards on the territory of the Centre follow the legislation of the Republic of Kazakhstan. The English translation on aifc.kz reads "Awards of arbitration courts in the Republic of Kazakhstan", which is narrower. Article 45(1) of the AIFC Arbitration Regulations provides for recognition and enforcement by the AIFC Court of an award "irrespective of the State or jurisdiction in which it was made". The structure of Article 14 supports the narrower reading; on it, the two rules overlap only for awards made in Kazakhstan outside the AIFC. We do not claim that Article 45 cannot be applied.

Proposed correction

Please align the English translation of Article 14(4) with the Russian and Kazakh texts, and clarify how Article 45 of the Arbitration Regulations relates to Article 14(4).
