Arbitration Regulations Art. 9(2): for foreign-seated arbitrations Articles 17 and 18 apply, but not Article 16 (stay of court proceedings)
Article 9(2) of the AIFC Arbitration Regulations applies "Articles 17, 18, Part 3, and the Schedule" where the seat is outside the AIFC. Article 16 (what the AIFC Court must do when an action is brought in a matter that is subject to an arbitration agreement) is not listed. In the UNCITRAL Model Law (article 1(2)) the corresponding articles 8 and 9 apply whatever the place of arbitration. The AIFC Court can still stay proceedings under its general powers (section 27(2)(g) of the Court Regulations, rule 8.8 of the Court Rules), so the question is whether the Article 16 rule is meant to apply as well.
Proposed correction
Please confirm whether Article 16 is meant to apply where the seat is outside the AIFC.
