Court Regulations s.29(2) restates Article 13(6) of the Constitutional Statute as "shall be guided by decisions"; Article 13(6) says the Court may take into account final decisions

Section 29(2) of the AIFC Court Regulations says that the Court, "as provided by Article 13(6)" of the Constitutional Statute, "shall be guided by decisions of the Court and decisions made in other common law jurisdictions". Article 13(6) is permissive and limited to final decisions: the Court "может учитывать вступившие в законную силу решения" (may take into account final decisions). Being guided is not the same as being bound, so we do not see a clear conflict, but the restatement is not exact.

Proposed correction

Please consider aligning section 29(2) with the words of Article 13(6) of the Constitutional Statute.

Регламент Суда МФЦА, статья 29(2), передаёт пункт 6 статьи 13 Конституционного закона словами «руководствуется решениями»; пункт 6 статьи 13 говорит, что суд может учитывать вступившие в законную силу решения

Статья 29(2) Регламента Суда МФЦА указывает, что Суд, «как предусмотрено пунктом 6 статьи 13» Конституционного закона Республики Казахстан «О Международном финансовом центре „Астана“», «руководствуется решениями Суда и решениями, вынесенными в других юрисдикциях общего права». Пункт 6 статьи 13 сформулирован как возможность и ограничен решениями, вступившими в силу: суд «может учитывать вступившие в законную силу решения». Руководствоваться решениями — не то же самое, что быть ими связанным, поэтому явного противоречия мы не видим, однако пересказ неточен.

Исправление

Просим рассмотреть приведение статьи 29(2) в соответствие с формулировкой пункта 6 статьи 13 Конституционного закона.
