Court Rules fix filing and service cut-off at '4pm Alma Ata time (UTC + 6)'; Kazakhstan has used UTC+5 since 1 March 2024

Rule 2.12 requires any act due "on or before a particular date" to be done "by 4pm Alma Ata time (UTC + 6)", and rule 5.15 treats a document "delivered before 4pm Alma Ata time (UTC + 6) on a business day" as served that day. When the Rules were written both labels meant the same time. Since 1 March 2024 the whole of Kazakhstan uses the fifth time zone, UTC+5 (Resolution of the Government of the Republic of Kazakhstan No. 20 of 19 January 2024, amending Resolution No. 1749 of 23 November 2000). Since then "Alma Ata time" and "UTC + 6" differ by one hour: 4pm UTC+6 is 3pm local time, and 4pm local time is 5pm UTC+6.

Proposed correction

Please choose one time base for rules 2.12 and 5.15 - local time (for example "4pm Astana time") or a fixed offset - and remove the other label.

Правила Суда МФЦА устанавливают крайний срок подачи и вручения «16:00 по времени Алма-Аты (UTC + 6)»; с 1 марта 2024 года в Казахстане действует UTC+5

Правило 2.12 требует, чтобы действие, которое должно быть совершено «в определённую дату или ранее», было совершено «до 16:00 по времени Алма-Аты (UTC + 6)», а правило 5.15 считает документ, «доставленный до 16:00 по времени Алма-Аты (UTC + 6) в рабочий день», врученным в тот же день. Когда Правила составлялись, оба обозначения означали одно и то же время.
