ARXO-2026-0070 · Reported
PRU (Investment Firms) Table 3.3: a manager of a Single Family Office Fund without a custodian falls in two rows (USD 50,000 and USD 500,000)
Amendments No. 4 (in force 1 July 2024) added "or (b) because the Fund is a Single Family Office Fund" to the USD 50,000 row of Table 3.3. The USD 500,000 row for a Collective Investment Scheme "which does not have an appointed Eligible Custodian" was not changed; its only exception is the nature of the Fund and its assets. A manager of a Single Family Office Fund without an Eligible Custodian therefore meets both rows, and the text does not say which applies. Reading both rows cumulatively gives USD 500,000 and leaves the limb added by Amendments No. 4 without effect.
Proposed correction
Please clarify which row applies to a Single Family Office Fund without an Eligible Custodian and, if USD 50,000 is intended, exclude that case expressly from the USD 500,000 row.
